With respect to the handling of Personal Information

Privacy Policy (Personal Information Protection Policy)

Open Stance CO., LTD. (hereinafter referred to as “the Company”) operates Nishimachi STORE (hereinafter referred to as “the Service”). Through the Service, the Company aims to provide customers with quality products and services that are satisfactory, convenient, and beneficial. To this end, the Company utilizes the personal information of its customers and various other people who are involved with the Company, and the Company considers the protection of personal information to be one of its most important responsibilities.

The Company will clearly define the purpose of use within the scope necessary to provide this service, and collect, use, and provide personal information appropriately. Personal information obtained will be used only within the scope of the purpose of use, and measures will be taken to ensure that personal information is not used for any other purpose. Handling of Personal Information

Open Stance CO., LTD. (hereinafter referred to as “the Company”) will use personal information obtained or held by the Company in the operation of Nishimachi STORE (hereinafter referred to as “the Service”) for the following purposes. In cases where the Company receives personal information directly in writing, the purpose of use will be clearly stated in each case. Through the Service, the Company aims to provide customers with high quality products and services that are satisfactory, convenient, and beneficial to them. For this purpose, the Company will use the personal information it receives from customers and various other parties involved with the Company to the extent necessary. Please refer to the above for our privacy policy (personal information protection policy).

1. Personal information

Personal information is defined as an individual’s name, date of birth, age, gender, address, telephone number, family structure, hobbies, preferences, e-mail address, ID, place of employment, affiliation, work address, work telephone number, credit card number, bank account number, information on websites visited, complaints, consultations, or inquiries (information about an individual that can be used to identify the specific individual by name, date of birth, or other description contained in the information (including information that can be easily matched with other information and thereby used to identify the specific individual)).

2. Purpose of use of retained personal data

The Company will use the retained personal data it has acquired for the following purposes

3. Disclosure of retained personal data

If a customer requests disclosure of his/her personal data, the Company will comply with the request without delay. However, the Company may not disclose all or part of such data in the following cases

  1. If there is a risk of harm to the life, body, property, or other rights or interests of the person or a third party
  2. If there is a risk of significant hindrance to the proper conduct of the Company’s business
  3. If there is a possibility of violating other laws and regulations

4. Provision of retained personal data to third parties

The Company will use the retained personal data the Company has acquired only within the scope of the purposes of use specified in “2. Purpose of use of retained personal data.” The Company will not provide or disclose such data to any third party, except as required by law.

5. Consignment of retained personal data to third parties

The Company may outsource to a subcontractor the work necessary to achieve the purposes of use specified in “2. Purpose of use of retained personal data. In such cases, the Company will select as the consignee a company that meets the standards the Company has established, as well as sign a contract regarding the handling of personal information and conduct appropriate supervision.

6. Procedures for disclosure, correction, suspension of use, etc. of retained personal data

If the individual, legal representative, or authorized agent requests notification of the purpose of use, disclosure of personal information, correction, addition, or deletion of content, suspension of use, or deletion, etc. (hereinafter referred to as “Procedure for Requesting Disclosure, etc.”) of personal data held by the Company, the Company will respond with the following procedures using the request form prescribed by the Company. In the event of disclosure of retained personal data, the person shall choose either by providing electromagnetic records or in writing, and shall submit the following prescribed documents for identification.

To request “Procedures for Requesting Disclosure, etc.” of personal information, please contact us at “9. Contact for complaints and inquiries.” The Company will then send a “Request Form for Disclosure” necessary for the procedure.

(6-2) Procedure for Requesting Disclosure

Please fill in the prescribed items on the “Request Form for Disclosure” obtained in accordance with 6-1 above and send it to “9. Contact for complaints and inquiries” together with the documents for identification as described in (1) to (3) below. If the request is made by a proxy, a “Letter of Attorney” from the person himself/herself is also required.

– A copy of the seal registration certificate (within 3 months of the effective date and showing the applicant’s current address)
– A copy of the family register (within 3 months of the effective date)
– A copy of the certificate of residence (within 3 months of the effective date)

[B]
– A photocopy of passport (valid and showing current address)
– A copy of driver’s license (valid and issued by the Public Safety Commission of each prefecture)
– A copy of a valid official document that verifies the applicant’s identity, such as an insurance card (within the validity period)

(2) Identification documents for Procedures for Requesting Disclosure, etc., made by a legal representative, etc.
One item from the following A and one item from the following B

[A]
– A copy of the seal registration certificate (within 3 months of the effective date and showing the applicant’s current address)
– A copy of the family register (within 3 months of the effective date)
– A copy of the certificate of residence (within 3 months of the effective date)
(*Limited to documents that can confirm the relationship between the person in question and the representative.)

– A photocopy of passport (valid and showing current address)
– A copy of driver’s license (valid and issued by the Public Safety Commission of each prefecture)
– A copy of a valid official document that verifies the applicant’s identity, such as an insurance card (within the validity period)

(3) Identification documents for Procedures for Requesting Disclosure, etc., made by a proxy by power of attorney
“Power of Attorney” indicating representation, and one item from A below and one item from B below (for both the principal and the proxy)

[A]
– A copy of the seal registration certificate (within 3 months of the effective date and showing the applicant’s current address)
– A copy of the family register (within 3 months of the effective date)
– A copy of the certificate of residence (within 3 months of the effective date)

[B]
– A photocopy of passport (valid and showing current address)
– A copy of driver’s license (valid and issued by the Public Safety Commission of each prefecture)
– A copy of a valid official document that verifies the applicant’s identity, such as an insurance card (within the validity period)

(4) Notes on documents for identification
– Please fill in the part related to the domicile of the applicant in black.
– If the reverse side of the form has information on it, a copy of the reverse side is also required.

(5) Fees
Actual costs required for the procedure (costs for issuing official documents, photocopies, etc.) as well as postage and other communication costs for sending documents to the Company, are to be borne by the customer. The Company will bear the communication costs for sending documents from the Company.

(6) Cases in which the Company is unable to respond to a request for disclosure, etc.
The Company will confirm the contents of any request for disclosure that the Company receives and notifies the requester of the results at a later date. However, the Company will refuse to respond to the request in any of the following cases. In such cases, the Company will inform the reason why the Company is unable to respond.
– If the Company is unable to confirm your identity
– In the case of a disclosure request made by a legal representative, if the relationship with the person in question cannot be confirmed.
– In the case of a disclosure request made by a proxy, if the proxy’s authority of representation cannot be confirmed
– If any of the submitted documents are incomplete
– If the subject of the request for disclosure, etc. is personal information that the Company, at its own discretion, is unable to respond to the request
– If the Company is unable to respond to your request for disclosure for any other reasonable reason

(7) Purpose of use of personal information obtained by the Company in connection with the application
Personal information provided in connection with requests for disclosure procedures, etc. will be managed to the extent necessary to investigate, identify, and respond to each request for procedures. The information will be disposed of as soon as possible after the response to the request has been completed.

7. Handling of personal information on the website

(1) Use of Cookies
The Company’s website sends information called cookies to user’s computer in order to identify user’s computer and improve convenience. Cookie information is used to identify the computer and is not used to identify the person personally.

(2) SSL
The Company’s website is SSL-compatible to protect customers’ personal information. Personal information such as names, addresses, and telephone numbers entered by customers is automatically encrypted before being sent and received, so that even if a third party intercepts the transmitted data, there is no need to worry about the contents being stolen.

(3) Access logs
The Company’s website records information on visitors in the form of access logs.
